Aditya Infotech Limited and its Affiliates (as hereinafter defined) (“we”, “us”, “our”, or “CP Plus”) are committed to protecting your privacy. The gCMOB Privacy Policy (this “Policy”) describes our practices in connection with information privacy on Personal Data (as hereinafter defined) we process through your use of our products and services (collectively, the “Services”), for instance the gCMOB Mobile Application (the “App”) and its connected Smart Devices.

Before you start using the Services, please carefully read this Policy which details our purposes for collecting and processing your Personal Data, as well as how we use, store, share and transfer your Personal Data. In this Policy you will also find ways to exercise your rights of access, update, delete or protect your Personal Data.

Affiliates shall include, without limitation, CP Plus’s parent companies, subsidiaries, and such subsidiaries under common control of the same parent company as CP Plus.

Personal Data means information generated, collected, recorded and/or stored, electronically or otherwise, that can be used to identify an individual or reflect the activity of an individual, either from that information alone, or from that information and other information we have access to about that individual.

Personal Sensitive Data includes personal biometric information, communication records and contents, health information, transaction information, and precise location information, etc., according to various data protection laws and regulations. When we collect Personal Sensitive Data from you, we will generate an explicit notification for your consent before we collection personal sensitive data about you.

Smart Devices refers to those computing devices produced or manufactured by hardware manufacturers, with human-machine interface and the ability to transmit data that connect wirelessly to a network, including smart camera, Recorders, Video door phones etc.

  1. What Personal Data Do We Collect?

    To provide the Services to you, we will ask you to provide necessary Personal Data that is required to provide those Services. If you do not provide your Personal Data, we may not be able to provide you with some Services.

    1. Information You Voluntarily Provide to Us

      Registered Account Data: When you register an account with us, we may collect your account contact details, such as your email address, username, and login credentials. During your interaction with the Services.

      Information based on additional functions:

      To offer you with more convenient and higher-quality Services with optimized user experiences, we may collect and use certain information if you consent to use of additional functions in the App. Please note, if you do not provide such information, you may continue to use basic Services of the App and connected Smart Devices, but certain features based on these additional functions may not be available. These additional functions may include:

      Additional functions based on location information:

      When you enable the location-based functions through permission settings on your mobile device, we will collect and process your location information to enable these functions, such as pairing with your Smart Devices.

      You may disable the collection and use of your location information by changing your mobile device settings ("App management - Switch on/off Location Information"), upon which we will cease to collect and use your location information.

      Additional services based on camera:

      You may use the camera to scan the code by turning on the camera permission to scan QR code. Please be aware that even if you have agreed to enable the camera permission, we will only obtain information when you actively use the camera for scanning codes, video recording, etc. You may opt-out the using of camera permission: "App management - Switch on/off Camera".

      Additional services for accessing and uploading pictures/videos based on photo albums (picture library/video library):

      You can use this function to download pictures/videos after turning on the storage permission. When you use the photos and other functions, we will not recognize this information.

      You may opt-out the using of photo album permission: "App Management - Switch on/off Access storage permissions".

      Additional services related to microphone-based service:

      You can use the microphone to send voice information after turning on the microphone permission, such as one-way/two-way communication with camera/Recorder. Please be aware that even if you have agreed to enable the microphone permission, we will only obtain voice information through the microphone when you voluntarily activate the microphone in the App.

      You may opt-out the using of microphone permission: "App Management - Switch on/off Microphone".

      Additional services based on storage permission:

      The purpose is to ensure stable operation of the App by utilizing the storage permission. After you give or indicate the permission to read/write your mobile device’s storage, we will access pictures, files, crash log information and other necessary information from your mobile device’s storage to provide you with functions such as information publications or recording the crash log information locally.

      You may opt-out the using of storage permission: "App Management - Switch on/off Access Storage permissions".

      Additional services based on Notification permission:

      The reason why we ask you for the permission is to send you notifications about using the Smart Devices or Services, especially if you have purchased security services and you require an alert or message so that you can capture the real-time status.

    2. Information We Collect Automatically

      Mobile Device Information:

      When you interact with our Services, in order to provide and maintain the normal operation of our Services, to improve and optimize our Services, and to protect your account security as well, we automatically collect mobile device information, such as mobile device model number, IP address, wireless connection information, the type and version of the operating system, application version number, push notification identifier, log files, and mobile network information. Meanwhile, we will collect your software version number. In order to ensure the security of the operating environment or to provide services, we will collect information about the installed mobile applications and other software you use.

      Usage Data:

      During your interaction with our websites and Services, we automatically collect usage data relating to visits, clicks, downloads, messages sent/received, and other usage of our websites and Services.

      Log Information:

      When you use the App, in order to improve your user experience, the system and exception log may be uploaded, including your IP address, language preference setting, operating system version, date or time of access, so that we can facilitate and accurately identify problems and help you solve them in timely manner.

    3. Video and Audio Data

      The App allows you to access and view surveillance data captured or recorded by Compatible Hardware (as defined in the Terms of Use). This “Surveillance Data” comprises:

      • Video (and in some cases audio) recordings or live feeds or streams and still photographic images.
      • Readings or data from physical or virtual sensors (to the extent offered by or included with Compatible Hardware and supported by the App), including:
        • Motion detection sensors
        • Event sensors
        • Temperature sensors
        • Window/door sensors
        • Passive infrared sensors
        • Water sensors
        • Carbon dioxide sensors
        • Ambient light sensors

      Your Surveillance Data is captured and stored locally on your Compatible Hardware and/or on your device where the App is installed. We treat your Surveillance Data differently than other data types.

      Notwithstanding anything to the contrary in this Policy, neither we nor our service providers will access your Surveillance Data, except:

      • With your consent for the limited purpose of providing support services to you in connection with the App and/or the Compatible Hardware or for such other purposes as you may authorize or designate.
      • To the extent legally compelled, including, without limitation, as required by subpoena, judicial order, civil investigative demand, or other similar legal process.
    4. Information We Collect, Purposes of Processing and Legal Grounds

      We collect information from and about users of our App:

      • Directly from you when you provide it to us.
      • Automatically when you use the App.

      We have set out below, in a table format, a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate. We try to ensure that we only collect and hold personal data that we need for the services and products we are offering to you. Therefore, unless otherwise indicated in the table below, the provision of personal data is a requirement for us to enter a contract with you or fulfil our contractual obligations. In case that you choose not to provide certain information; you might not be able to take advantage of our services in full or partially. Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. When you log in and use our services Apart from the information mentioned under item 1, we process data related to your mobile device and Internet connection you use to log in, like GPS, mobile device’s operating system, unique model and its unique identifier, IP address, MAC address, software version, network access mode & type, latitude & longitude (if needed), and operation logs, certain details of your access to and use of the App, including traffic data, logs, and other communication data and the resources that you access and use on or through the App. To offer our services to you, maintain our services’ normal operations, optimize our services and secure the safety of your account. If you do not want us to collect information as specified in item 2, you can remove permissions from app management, or you may not download the App or delete it and clear cache.

We use the information we collect to provide or improve services provided by us, our partners, or other trusted third-party vendors, such as providing, evaluating, improving, or upgrading services; participating in market research activities related to our services, developing new services, providing customer support, etc. To improve the services, we may also analyze product usage, but these statistics will not include any of your identifiable personal information.       We collect records and copies of your correspondence (including email addresses), if you contact us. We use your contact details to communicate with you, provide you with information you request about us, answer your questions or when we handle your complaints.     Accessing and Correcting Your Personal data

You may also object to or request us to restrict the processing of your personal data. If we process your personal data based on consent, you may withdraw your consent at any time by contacting us (see below). A summary of your legal rights is set out below:

    • Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

    For security reasons, we will take steps to authenticate your identity before providing access to your personal data. You also have the right to lodge a complaint with the relevant Data Protection Authority.

    Data Security

    We have implemented measures designed to secure your personal data from accidental loss and from unauthorized access, use, alteration, and disclosure.

The information you share in public areas may be viewed by any user of the App.

    Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted through our App. Any transmission of personal data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

    Changes to Our Privacy Policy

    We reserve the right to modify this Privacy Policy from time to time in our sole discretion. If we made material modifications to the Privacy Policy, we will notify you sending you an in-App alert the first time you use the App after we make the change. The date this Privacy Policy was last revised is identified at the top of the page. All changes are effective immediately when we post them and apply to all access to and use of the App thereafter; provided, to the extent required by law, we will seek your affirmative consent prior to applying material modifications to this Privacy Policy on how we use or disclose personal data that we collected or received prior to the date of the modification.
